What is meant by “Substantial Performance”?

Substantial Performance is defined in GC 18.6 and the Builders Lien Act. It means the project is complete enough for its intended use, and only minor deficiencies remain. Once certified, it triggers:

  • Release of holdback (after lien period)
  • Start of warranty period
  • Project handover procedures
